ProgressPlay Ltd. (the “Company”), whose registered address is at Soho Office, 3A, Punchbowl Centre, Elia Zammit Street, St. Julians, STJ3154, Malta, is the operator of this website. The company is registered and controlled by the Gambling Commission in Great Britain under account number 39335, and it conducts online games in compliance with the Malta Gaming Authority, license number MGA/B2C/231/2012 issued on April 16, 2013. Your (“You”, “Your” or “Player”) usage of the online and mobile gaming services that the Company provides to You is governed by these terms and conditions (the “Terms and Conditions”). The Company does not want to give You the ability to break any laws. You guarantee, represent, and commit to making sure that your use of the website and/or services complies with all relevant laws, rules, and ordinances. If You live in an area where using the Services is currently prohibited by law (including, but not limited to, the Restricted Territories), or if the Company, in its sole discretion, chooses not to offer Services, then the offering or availability of the Services shall not be deemed or interpreted as an offer or invitation by Us to use the Services.

Regarding the legality of the Services, the Site, and/or any person’s involvement in the Services through this Site, we make no express or implied claims or warranties. We further disclaim any liability for any unauthorized use of the Site by You. It is incumbent upon You to make sure that, before to registering or using any of the services offered by this Site, You are in compliance with all applicable laws. Regarding the legality of Your use of the Site and/or the Services, You should speak with legal counsel in the relevant jurisdiction.

Participants in the Services are not permitted to be anyone connected, directly or indirectly, to the computer systems or security system used by the Company, its directors, officers, employees, affiliates, subsidiaries, and any other person involved in the operation of this Site and its establishment, including, but not limited to, advertising, promotion, and fulfillment agencies, insurers and legal advisers, webmasters and web suppliers, and their families. In order to maintain good order, it is made clear that anyone who is not permitted to participate as stated above, as well as anyone who replaces them, are not eligible for any of the prizes offered by the site. The company also retains the right to suspend the account (freezing any money deposited in it) and to nullify any bonuses, winnings, or bonus winnings that may be found there.

Account Operation

You will not make any illegal deposits into Your Account because it is against the law to do so. You hereby agree, without affecting the foregoing, that the Company will monitor all transactions to avoid money laundering and will notify the appropriate authorities of any suspicious activity.

Credit (not available in the UK) and Debit Card, PayPal, PayviaPhone, Neteller (not available in the UK), Paysafecard, Skrill (not available in the UK), Trustly, Zonda, Ecopayz, and BitBayPay are the possible deposit options with the Company. The currency you have selected and the country in which you registered determine which payment method is available. 

Only after the deposit has been validated by the Company and the applicable payment method will Your Account be credited with the deposit; the deposit will not appear in Your Account’s balance until such confirmation is received. The Company neither gives credit nor engages in, plans, authorizes, or knowingly assists in the provision of credit. A 15% processing fee is applied to PayviaPhone deposits, and this fee will be subtracted from the total amount of your deposit.

For the avoidance of doubt, you are not permitted to use credit cards in any way to make deposits into an account that is governed by the Gambling Commission. This includes using credit cards that are linked to online payment services or e-wallets.

We would like to bring to your notice that the Company has the authority to set deposit restrictions, at its exclusive discretion, and subject to a number of internal assessments and verifications. These could change over time and based on several factors specific to each customer and deposit; Paysafecard, for instance, has deposit amounts ranging from €10 to €700 per site.

According to the terms of the Gambling Commission’s license, the company must notify all customers in the UK whose accounts are governed by the commission about what happens to the money held on their behalf and how much is protected in the event of insolvency. In compliance with its regulatory responsibilities, the Company will keep the money of these clients segregated from the Company’s own accounts by keeping them in a different bank account. In the event that we become insolvent, these monies are not safeguarded.

You shall promptly notify the Company of any loss or theft of the payment method, as well as any modification to the payment method; You shall bear all costs and damages resulting from Your failure to do so, and We shall not be responsible for any such fees.

It is not permitted for you to provide money to other players from Your Account or accept money into Your Account from other players. It is also not permitted for you to buy, sell, or transfer Accounts from other players.

If you haven’t signed into your account for twelve (twelve) months, it will be considered inactive if your account is governed by the Malta Gaming Authority. If the company notifies you thirty (thirty) days in advance of your account becoming inactive, an administrative fee equal to five (five) euros per month will be charged for any inactive accounts; the maximum amount of fees that will be charged will be your account’s balance. When 30 (thirty) months pass without you logging in, Your Account will be considered dormant. In that scenario, the Company will either send the remaining balance to You (after deducting the charges mentioned in this section) or, if You cannot be located, to the Malta Gaming Authority.

In the event that Your Account is closed, blocked from further use, or becomes inactive, You may, at your discretion, contact the Company at [email protected] and request that Your Account be reopened and/or have the balance returned to You, without affecting the Company’s right to seize and forfeit any and all funds held in Your Account. To be clear, the Company is not obligated to accept Your request; instead, it will be evaluated in light of the applicable legal requirements, the relevant facts, and circumstances.

You may request to close Your Account at any time by emailing [email protected], the company’s customer help email address. 

Any bets made after the event starts (with the exception of in-play wagers) and/or after the outcome of the bet is known are void and do not grant You the right to any profits; in these situations, the bet amount will be reimbursed to You.

At its sole and absolute discretion, the Company may provide a cash-out feature in some Bets on certain Events. If available, this option will let you cash out all or a portion of your wager before the wager’s expiration date. The return that You receive in accordance with the cash-out option is subject to change throughout the Event and will be decided solely and exclusively by the Company. We are not obligated to offer the cash-out facility in any Event or Bet, and we are free to discontinue this feature completely without having to give any prior warning.

In the event of a discrepancy between the official results and other sources of information, the Company will determine the outcome of the Bet. The official results published by the relevant governing bodies organizing the Events and/or alternative sources of information are acknowledged as the official results of the Bet by the Company. The Bet will be void and Your wager will be repaid if the Company is unable to ascertain the outcome of the Bet.

The Company will post the outcome of the Bet on the Site. Within 72 hours of the Company posting the outcome of the Bet, any winnings will be credited to the Account. Should there be a discrepancy between the outcomes displayed on the website and those recorded in the Company’s systems (or in systems managed by third parties on the Company’s behalf), the latter will take precedence.

Authority and Capabilities of the Organization

In the event that the Site malfunctions or there are any errors pertaining to Events and/or Bets—including, but not limited to, inaccuracies in the odds, participant names, handicaps, and/or any other aspect of the Bet—the Company will use commercially reasonable measures to prevent such errors. However, the Company shall have the right to terminate Your participation in any of the Games in which the malfunctioning has occurred in the case of a technical breakdown (or any other error) in the Site’s systems for any reason. If such a situation arises, Your Account will be credited with the participation fee and/or Bet that You paid to participate in the Game. In such case, Our obligation and liability will be restricted to that amount alone.

If for any reason the Services cannot be carried out as scheduled, including but not limited to infection by computer virus, bugs, tampering or unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Company, the Company reserves the right to cancel, terminate, modify, or suspend the Services. You will not be entitled to these winnings if any errors cause winnings to be awarded to You or increase winnings that are owed or paid to You. The Company may, at its discretion, deduct an amount equal to those winnings from Your Account or set off such amount against any money owed to You by the Company. You must notify the Company of the error right away and repay any winnings credited to Your Account in error to the Company (as directed by the Company).

In its sole discretion, the Company may cancel, terminate, modify, or suspend its Services to You. In the event that it does so, it will give You clear written notice of its decision and ensure that it does not affect any rights that You may already have.

The Company reserves the right to limit, refuse or cancel any bet, stake or other wager made by You or through Your Account, as well as cancel any Game (regardless of whether such cancellation was due to actions on Your part or of any third party), where the Company believes that any act of fraud or any other act of bad faith has been taken against the Company or any third party; including, but not limited to, if the Company reasonably suspects that the integrity of the Event has been questioned, whether by You, by any person associated with You and/or by any third party (such suspicion may arise on the basis of the size, volume, number and/or pattern of Bets placed by You and/or other persons with the Company and/or with third parties as well as any investigation initiated by the applicable authorities and/or Event organizer or sports body); in such circumstances You will only be entitled to receive the participation fee sum and/or Bet that was paid by You for participating in such Game, Your Account will be credited accordingly and You will not be entitled to any winnings from the applicable Game, and if any such winnings were paid to You, the Company shall reduce Your balance by the amount of such winnings (and if the Account balance is insufficient, You shall reimburse the Company with the remainder amount). 

The outcomes of the Games and the balance of Your Account will remain the same if You are removed from the Internet while participating in them (and not as a result of Your purposeful disconnection or any other act of bad faith). After you have placed a wager, the Company will make every effort to ensure that, in the event that You encounter disruptions and/or technical issues with any Game, You will be able to continue play and get the Game back to its pre-interruption state. If the restoration is not possible, the Company will make sure the game is stopped, return the wager to Your Account, notify the Malta Gaming Authority or the Gambling Commission right away, whichever is applicable, and prevent you from playing the game again if there is a chance the failure that occurred will happen again.

The Company shall have the right, at its sole discretion, to change, alter, or terminate any of the Services, bonuses, or promotions at any time, as well as to add new Games, Services, bonuses, or promotions; provided, however, that such actions are not applied retroactively. Bonuses awarded before the modification won’t be impacted. You will not have any rights against Us in this regard, and We won’t be responsible for any losses you sustain as a result of any modifications we make.
